On Wednesday, Washington, D.C.'s Federal US Circuit Court of Appeals ruled that Apple must be able to revive its claims at the International Trade Commission. Apple said the Motorola Mobility division of Google Inc. infringed two of the patents used in iPhone and owned by Apple.

The Court of Appeals discovered that the ITC committed an error when it decided that Motorola did not infringe Apple's patent while at the same time invalidated Apple's other patent arguments. The court sent the case back to ITC for further investigation of the matter.

Apple's spokesperson refused to give a comment while Motorola said the verdict would pave the way for the ITC to discover that the outstanding claims of Apple were invalid. "Meanwhile, we'll stay focused on delivering great new phones that people love," Motorola added.

Last October 2010, Apple filed a complaint versus Motorola at the ITC. The protest involved patents on the technology behind touch screens. When the lawsuit began, Google purchased Motorola Mobility for US$12.5 billion.
