In its annual M&A Jamboree in New Orleans held this week, dealmakers delivered its verdict on judges who make superfluous legal rulings to the detriment of their business. They all say that courts 'should stick to the facts and the law.'
One of the highlights occurred last July where the US Supreme Court was showcased with fellow justices backstabbing the Chief Justice John Roberts in his drive to uphold the healthcare law. In another instance, Delaware Supreme Court Justice Myron Steele criticized Chancellor Leo Stine's diatrtibe of an opinion.
The puns and the comedic diatribes highlight a specific point. Ordinarily, legal constraints are unable to cover all the possible angles so judges misuse the bench to right wrongs and guide behaviour of lawyers, which is in essence judicial legislation. This only creates confusion for those following the precepts of the law.
Until then, practitioners carry their case to court at the mercy of the judges hearing them.
