Samsung appeals to the Supreme Court after the lower court's infringement decision against Apple's patent

Samsung is bringing its complaint against Apple to the higher judiciary, the Supreme Court. This is after the decision of the lower court, that the former company believes to have misapplied its law. The lawsuit is all about the patent infringement that has been filed against Samsung.

9to5Mac noted that Samsung believes two mistakes that the lower court has applied. First argument is the failure to look at the difference between functional and ornamental features. Samsung's lawyer said that Apple's and Samsung's phones both have rectangular shapes, rounded corners, flat screens and colorful icon grids, but ornamentally different.

The second argument is the demand of high damages award that has been ordered by the court. As The Hill reported, Samsung is being asked to pay 100 percent of the company's profit from the phones with infringement patents. The lawyer said, "It was wrongly ordered to pay Apple all of its profit from infringing profits." Related report said that Samsung claims the 1887 law is outdated for modern products. In this regard, the company is requesting the court to review its law surrounding design patents.

Further, Apple's spokesperson said, "It makes its products to delight our customers, not for our competitors to flagrantly copy," according to the related report. Nevertheless, Samsung is continuing the battle against Apple despite of paying the latter company with an amount of $548 million. Though, Samsung will ask for part of the money back once the patents are ruled invalid in the Supreme Court.

On the other hand, CNET noted that it is unclear whether the Supreme Court will consider the case. It is known that the case between Samsung and Apple has been filed for such a long time and it was just earlier this month when the lower court came up with the decision.

As of the moment, there are no further details regarding the Supreme Court's decision. Samsung has yet to provide an official statement regarding the progress of its appeal in the higher court.
