Deutsche Telekom emerged victorious when a Frankfurt court dismissed an overcharging case filed against the telecommunications company. The lawsuit charged Deutsche Telekom of overcharging Kabel Deutschland for the use of its cable ducts and pipe network that housed phone and internet lines.
While in talks with Vodafone regarding a buyout deal, Germany's largest cable operator had filed a lawsuit against Deutsche Telekom. Kabel sought to reduce the annual charges of about EUR100 million by about two-thirds. It also wanted a repayment of fees paid from 2004 to 2011, amounting to approximately EUR273 million.
The district court in Frankfurt, said on Wednesday that it could not be determined whether Deutsche Telekom had abused its market position and charged the cable company too much.
A spokesman from Kabel Deutschland said the company would study the ruling and would most probably appeal against the decision.
