Current events are not working in favor of the sentencing of Oscar Pistorius. His defense lawyers failed to stop the appeal submitted by the prosecutors from culpable homicide to murder of her then girlfriend Reeva Steenkamp.
Thokozile Masipa on the other hand denied the possibilities of her ruling out her decision to grant the appeal of the prosecutors for a heavier crime against Pistorious as the case is about to be heard in the supreme court in a later date this year. Masipa even further added that prosecutors can file for reconsiderations since he interpretation of the law were the details that lead her to her earlier verdict on the case.
Pistorious defense team on the other hand argued that the state should base their verdict on "matters of fact" and not the law.
After a few discussions, Masipa gave her conclusion. "I am not satisfied that this court is the correct court to hear this application. For one thing, there is really nothing new in the submission by counsel for the applicant. In my view, to entertain this application will be tantamount to reviewing my own decision. And I also think that, procedurally, it would be wrong to grant or refuse this application. Accordingly, the order that I grant in this matter, is to strife off the application."
Pistorious might possible receive a higher sentence as prosecutors tries to move their case to a higher court.
Oscar Pistorious was stripped of with honorary degrees awarded to him by a Scottish Institution back in 2012 last February due to his involvement in the death of Reeva Steenkap and after being involved in illegal possession of firearms in 2013.. The Olympic Amputee star was sentenced for five years in jail after "accidentally" killing Reeva Steenkamp on Valentine's Day of the same year. Up to this date, Oscar Pistorious still claims that the killing was unintentional.
