Tom Brady Suspension: ‘New England Patriots’ Star Files Lawsuit Against NFL Claims its Deflategate

Shortly after Tom Brady suspension was announced, the 'New England Patriots' star and the NFL Players Association filed a lawsuit to uplift the suspension given to the star player over his involvement to the football tampering scandal "Deflategate." The case filed at the U.S. District Court in Minnesota, alleges Commissioner Roger Goodell's of his fairness.

Brady and the NFLPA questioned the decision of the agency for suspending him for long time. In the suit, they claimed that Tom Brady suspension is quite dubious which usually ends up only with a nominal fine, PEOPLE reports. In the 54-court documents, the team also complained that the star player didn't get any advanced notice.

On Tuesday, the day the Tom Brady suspension took in effect, the union is apparently planning to ask the court if it's possible for the New England Patriots quarterback to play or for the federal court to decide on the matter before the intended game of the Patriot's on Sept. 10.

"Courts are very protective of their jurisdiction," Jodi Balsam, who served as counsel to football operations from 2002-2007 and an associate professor and director of civil externship programs at the Brooklyn Law School told USA TODAY Sports.

"It's very rare that a court would not honor the first filer in their jurisdiction. There are now two conflicting lawsuits with the NFL's and the union's. And the first one filed usually has the presumption of jurisdiction and usually is the seat where the case is tried."

Mark Schamel, a legal expert at Womble, Carlyle, Sandridge & Rice, stated that Brady's case is different as he is the only player who can throw a case against the league. Schamel believes Brady has the "success and reputation" that other players don't have. Furthermore, the star player have the best lawyer in the country.

Tom Brady suspension comes after the NFL headed by Commissioner Roger Goodell imposed the penalty to Gisele Bundchen's husband for suspecting the star player of cheating, TMZ reports. Brady allegedly destroyed his Samsung phone to cover up any evidence.
