Nick Diaz positive for marijuana; UFC champ will face court for DUI and drug use

UFC welterweight Nick Diaz is expected to serve a one day imprisonment for driving under the influence (DUI) of alcohol. Aside from this, he is also set to appear in court to hear a drug case after testing positive for marijuana. Diaz' lawyer meanwhile is worried that they may not be able to get a settlement from the Nevada Athletic Commission (NAC).

Nick Diaz, a Stockton welterweight fighter, tested positive for using marijuana and he is set to go to court either on August or September after delays. Recordnet reports that the 31-year old fighter from California tested positive for marijuana metabolites after losing to Anderson Silva in a UFC fight last January 31.

This is different from another case Diaz is involved in wherein he is expected to turn himself to the San Joaquin County Jail on September 3 for DUI. The one-day imprisonment was supposed to be last June 25 but Diaz pleaded.

Fox Sports reports that Diaz will face the NAC who suspended him from the said sport for one year because of the drug discovery. Aside from the suspension, Diaz will have to await corresponding punishment from the court with regards to his illegal drug use.

NO SETTLEMENT?

The said test has been Diaz' third failed drug test. The News Hub says that since the offense has been repeated for a number of times already, Diaz might face a heavier punishment.

Diaz's lawyer Lucas Middlebrooke meanwhile has apprehensions that they might not be able to get a settlement from the NAC although he earlier said he was confident that they would be able to. Middlebrooke was arranging a settlement with Nevada deputy attorney Christopher Eccles when he learned that a settlement between the NAC and boxer John Molina was declined for the same offense.

Still, Nick Diaz is expected to plead not guilty in court for illegal drug use.
