Judge Ruth Kwan of the Superior Court in Los Angeles, where the controversial case between Kelly Hylands and Abby Lee Miller was lodged, dismisses partially the claims of Kelly and her daughter against Abby.
The Judge was not convinced on the allegations of Kelly that her daughter Paige suffered emotional and mental anguish caused by Abby since there is no psychiatric evaluation that supports her claims. According to the Judge "That's assuming nothing else goes on in the life of a young child."
The Superior Court Judge is also not convinced that Abby defamed Kelly when the former called the latter a bad mother and a drunkard. The judge reasoned out that Abby's statements are merely her own opinion and not necessarily founded on facts. Judge Kwan even stated that the Jury will have a tough call in deciding the defamation issue based on the evidence presented.
The whole legal altercation between the Hylands and Miller originated on of the episodes of Dance Mom wherein Kelly alleged that the TV Host treats her daughters in an insulting and bullying manner. It escalated quickly and resulted to a public scuffle wherein the two of them shouted at each other and ended up with Kelly slapping Abby.
Things even got worse when Abby went on The View to talk about the whole incident between her and Kelly.
The trial date for the case was scheduled on April 11, 2016 and it will only include the claims of the Hylands for Breach of Contract against Collins Avenue Company as based on the allegations of Kelly that they were suspended from the show without any writing and that Dance Mom owes them money.
