The 2nd District Court of Appeal in Los Angeles has decided that Kim Kardashian and Kanye West can push through with their lawsuit against YouTube co-founder Chad Hurley over leaked videos of West's proposal to Kim. The lawsuit was first filed in 2013 after Hurley posted the elaborate video on his website MixBit.
The three-justice panel determined that Kanye West and Kim Kardashian have a chance of winning a case against Hurley. The couple filed breach of contract, fraud and unjust enrichment claims against Hurley in 2003.
The panel threw out YouTube's co-founder claim that the confidentiality agreement he signed did not apply to the entity that was his website MixBit. Hurley's lawyers argued in the appeal that their client's First Amendment and free speech rights protected him after posting the video on his website.
Lawyers for the celebrity couple showed enough evidence to show that MixBit was struggling in terms of traffic and revenue which could have prompted the decision to post the video. The leaked marriage proposal video did give the website a surge in popularity. The posting of the video though has enraged Kanye West enough that he went to court.
The leaked marriage proposal video was shot and supposed to be shown on the reality TV series "Keeping up with the Kardashians". Shortly before it was aired though, the video has already been seen by the world on MixBit.
Kanye West and Kim Kardashian started dating in 2012. In October of 2013, the two announced that they were engaged. The wedding happened in May last year at Fort di Belvedere in Florence, Italy. The couple has a daughter named North West.
Hurley's camp is yet to issue a statement after the decision was handed down. There is also no word on how much West and Kardashian could be seeking from Hurley. The couple's lawyer Eric George simply stated that "Mr. Hurley got significant value that must be reimbursed to my clients."
