Teresa Giudice is alleging his former bankruptcy attorney of malpractice resulting to her 15-month sentence. The Real Housewives of New Jersey star filed a petition in the Manhattan Supreme Court Wednesday, and is suing his previous lawyer $5 million.
Speaking for Giudice, Attorney Carlos Cuevas told Entertainment Tonight that James Kridel's malpractice "is the reason that Mrs. Giudice is currently incarcerated." According to Giudice, Kridel mishandled the whole case. The reality star believed that his former attorney failed to report their full income on the bankruptcy petition they filed in 2009.
"The missteps were so bad she had to plead guilty to bankruptcy fraud," Cuevas stated. "Emotionally it's a tremendous strain, because imagine going to bed at night and not being able to say to your children, 'I love you.'"
Back in October, when Giudice started her jail sentence, Kridel told PEOPLE that the reality TV star has no knowledge with her finances. The lawyer claimed she has no idea how to handle her family finances until she will be the breadwinner. In short, Kridel was blaming the Giudice matriarch that she had been guilty for offense mistakenly.
INQUISTR reported that Kridel disclaimed his malpractice and further blames Teresa. He said she solely committed the crimes without his participation. He added Teresa pleaded guilty to the offense because she forged her assets in the documents.
Teresa and Joe pleaded guilty to 39 bank, mail, bankruptcy and wire fraud charges in March 2014. She pleaded guilty to four counts while her husband pleaded guilty to five counts.
By Oct. 2014, Teresa began serving her jail term and paid restitution charges of $400,000. Apparently she is required to surrender 25 percent of her "Real Housewives of New Jersey" salary, in which she will be receiving $1 million. Teresa is expected to be released by December while her husband, Joe will be serving his 41-month term jail sentence.
