Kelly Rutherford Bids Goodbye to Children: Loses custody lawsuit; Slams judge's decision

Kelly Rutherford was ordered to court last Tuesday August 11. It was during this time that Rutherford was ordered to present her children before the family court after her German ex husband, Daniel Giersh accused the actress of abducting and kidnapping their children. Rutherford failed to fly her two kids home last August 7th. Rutherford lost the case to keep her children with her in America.

The 6-year long custody battle Kelly Rutherford has been fighting heated up even more when the actress failed to follow court orders and stopped her children getting on a flight back to their father in Monaco. In a report from People, Rutherford had to say goodbye to her kids after Judge Ellen Frances Gesmer of the New York Supreme Court ordered the two minor kids were to be returned to their father immediately.

Though Rutherford was ordered to bring her two minors along with her, she arrived alone assuring the court that the kids were safe and only 10 minutes away from the New York Supreme Court. Her reason for not bringing them was to protect them from the media.

Another report from Today states how the actress was left devastated as she had to say goodbye to son Hermes 8, and daughter Helena 6. On Wednesday following the court finalization, Rutherford made a stated through her lawyer saying "What the judge did yesterday was shocking, illegal, and abusive to my children."

According to Abc News, Kelly Rutherford has called the whole ordeal a 'shocking' turn of events after she lost the battle to keep her children with her. She is now slamming Judge Ellen Frances Gesmer for having no authority to seize her children and their passports, and forcing them to leave the United States to live in Monaco where neither her children, herself, and ex husband are citizens.

Kelly Rutherford has also stated that she and her legal team are seeking help from the United States State Department, but so far have had no help. Rutherford's two children are now back with their dad.
